Terms of Service

1. Agreement to Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Host” or “you”) and YourGuide, a business operating from Waterford, Ireland (“we”, “us”, “our”), governing your access to and use of the platform available at yourguide.ie (the “Service”).

By creating an account, purchasing a subscription, or otherwise accessing the Service, you confirm that you have read, understood, and agree to be bound by these Terms in full. If you do not agree, you must not access or use the Service.

We reserve the right to update these Terms from time to time. Where changes are material, we will notify active Hosts by email prior to the changes taking effect. Continued use of the Service after the effective date of any revision constitutes your acceptance of the updated Terms.

2. Service Description

YourGuide is a self-service software platform that enables property hosts to create, manage, and distribute professionally designed property guidebooks. The platform operates on the following tiers:

2.1 Print Tier (One-Time Purchase)

Access to the YourGuide editor, guidebook generation tools, and a high-resolution, downloadable A4 PDF of your completed guidebook. The PDF is yours to print and distribute as you choose.

2.2 Hosted Tier (Annual Subscription - €49/year)

Everything in the Print Tier, plus a secure, PIN-locked digital guidebook page hosted at a permanent URL on the yourguide.ie domain. This page is intended for guests to access via a QR code or direct link and remains live for the duration of your active subscription. You may update your guidebook content at any time through your dashboard.

3. Billing, Renewals, and Cancellations

3.1 Payment Processing

All payments are processed securely by Stripe. By subscribing, you authorise Stripe to charge the payment method you provide. We never receive, see, or store your full card number, CVV, or bank account details.

3.2 Annual Subscription and Automatic Renewal

The Hosted Tier is billed at €49 per year, payable in advance. Your subscription renews automatically on the anniversary of your purchase date each year to ensure uninterrupted availability of your hosted guidebook page. Stripe will charge your stored payment method on the renewal date unless you cancel before then.

We will send a renewal reminder email to your registered address at least seven (7) days before each renewal date. It is your responsibility to ensure your payment details in the Stripe billing portal remain current.

3.3 Cancellation

You may cancel your Hosted Tier subscription at any time by clicking “Manage Billing” in your dashboard, which redirects you to the Stripe customer portal. Cancellation takes effect at the end of your current paid billing period, during which your hosted guidebook page remains fully live. After that date, your hosted page will be deactivated and made inaccessible to guests.

No prorated refunds are offered for any unused portion of a subscription year. If you cancel mid-year, you retain full access until your billing cycle ends, after which no further charges are made.

3.4 Failed Payments

If a renewal payment fails, Stripe will make a number of retry attempts over several days. If payment cannot be collected, your subscription may be suspended and your hosted guidebook page deactivated until payment is resolved. We will notify you by email if a payment fails.

4. Support and Maintenance Scope

YourGuide is a self-service platform. Your subscription does not include, and we do not offer under any circumstances as part of the standard subscription, any of the following:

5. Account Security

5.1 Magic Links

YourGuide uses passwordless “Magic Link” authentication. When you request access, a secure, time-limited login link is emailed to your registered address. You are solely responsible for maintaining the security of your email account. Any person with access to your inbox can use a Magic Link to access your YourGuide dashboard. If you believe your email account has been compromised, you should secure it immediately and contact us.

5.2 Guest PIN

Hosted Tier subscribers may set a four-digit Guest PIN to restrict access to their hosted guidebook page. You are solely responsible for distributing this PIN only to intended guests. We bear no responsibility for unauthorised access to your guidebook page that results from you sharing or publicly disclosing your Guest PIN, including but not limited to posting it on social media, leaving it in publicly accessible listing descriptions, or sharing it in insecure communications.

6. Acceptable Use

You retain full ownership of the content you submit to YourGuide. By using the Service, you represent and warrant that your content and your use of the platform comply with all applicable laws. You agree that you will not use the Service to:

We reserve the right to suspend or permanently terminate your account, without notice or refund, if we determine in our reasonable judgement that you have breached these Acceptable Use obligations.

7. Content and Intellectual Property

You retain all intellectual property rights in the content you create and upload to YourGuide. By submitting content, you grant us a limited, non-exclusive, royalty-free licence to store, process, and display that content solely as necessary to provide the Service to you.

All rights in the YourGuide platform itself - including its design, codebase, templates, and brand identity - remain the exclusive property of YourGuide. Nothing in these Terms transfers any ownership of platform intellectual property to you.

8. Limitation of Liability and Disclaimer of Warranties

8.1 Service Provided “As Is”

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. To the fullest extent permitted by applicable law, we disclaim all implied warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

8.2 Uptime

We make reasonable efforts to maintain continuous availability of the Service. However, we do not guarantee 100% uptime. Scheduled maintenance, third-party infrastructure outages (including those of Supabase, Cloudflare, or Stripe), and circumstances outside our control may result in temporary unavailability. We will not be liable for losses arising from service interruptions.

8.3 Content Accuracy and Guest Reliance

You are solely and entirely responsible for the accuracy, completeness, and currency of all content in your guidebook. YourGuide provides the tools to create and host your guide; we have no knowledge of or control over what you publish within it. We are not liable under any circumstances for any loss, damage, inconvenience, or harm arising from a guest relying on content in your guidebook, including but not limited to:

8.4 Limitation of Liability

To the maximum extent permitted by Irish and EU law, our total aggregate liability to you for any claim arising out of or in connection with these Terms or the Service - whether in contract, tort (including negligence), breach of statutory duty, or otherwise - shall not exceed the total fees paid by you to YourGuide in the twelve (12) months immediately preceding the event giving rise to the claim.

In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profit, loss of data, loss of goodwill, or business interruption, even if we have been advised of the possibility of such damages.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by Irish law.

9. Governing Law and Disputes

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the Republic of Ireland.

Both parties agree to submit to the exclusive jurisdiction of the courts of Ireland to resolve any dispute or claim arising out of or in connection with these Terms or the Service. If you are a consumer located in another EU member state, you may also have the right to bring proceedings in your country of residence under applicable consumer protection law.
